How Do TxDMV Rule Changes Affect Independent Dealers?

The Texas Department of Motor Vehicles (TxDMV) adopted changes to eight rules in the Texas Administrative Code that are effective June 28, 2017. Two of those rule changes apply to independent auto dealers. TIADA actively participated in the rulemaking process by reviewing the proposed rule changes, assessing the impact of the changes on our members, and providing written comment to TxDMV regarding the proposals. 

215.155 Buyer's Temporary Tags
  • The new Subsection (f) clarifies that if a vehicle is sold to an out-of-state buyer and the dealer is paying the $5 buyer temp tag fee through eTag, the entire fee will stay with TXDMV and be credited to the Texas Department of Motor Vehicles fund.
  • All other buyer's temp tag fees will stay with the county.
215.140 General Distinguishing Numbers
  • The rule is now clear that the premises requirements for GDN holders apply to each dealer when multiple dealers are licensed at the same location.
  • All licensed dealers at a location must have appropriate signage, display area, business hours, etc., that are unique to their GDN.
